What's A Physician or Hospital Lien?

Whenever an injured person receives medical treatment from a doctor, clinic or hospital, Illinois Law provides that the doctor or institution can file a
Lien to protect the costs of its services. These liens are sent by certified letter to the plaintiff's attorney and the defendant's insurance company. Liens must be paid or negotiated at the time of settlement and included on the Statement of Settlement. Even if a person has medical insurance, sometimes the physician may choose to file a lien, often to recoup a greater fee than allowed under the patient's discounted health insurance. If the health insurer did pay for medical treatment, they file a subrogation lien to recover their expenditures and prevent a windfall for the plaintiff (when the settlement compensates for medical bills).
