What Are Pleadings?

Lawsuits begin with a Complaint at Law, which may lead to an Answer (usually a denial of liability and damages) or a Motion To Dismiss, ostensibly arguing that the complaint cannot be maintained as a matter of law. Judges hear Motions to Dismiss and rule whether the litigation may proceed to Discovery, after which the Defendants may also bring a Motion to Dismiss on the evidence, or a Motion for Summary Judgment on the law.

In Illinois, plaintiffs have the right to file One Voluntary Dismissal Without Prejudice, and are then bound to re-file the case within one year of that dismissal or be forever barred.
