What is Discovery?
After the pleadings are filed, both sides engage in Written Discovery (Interrogatories and Requests for Production of Documents or things), and Oral Discovery (Depositions) of the parties, fact and expert witnesses, including medical doctors.
Depositions are controlled by the lawyers, out of court, and no judge presides over the proceedings. Deps routinely take place in the office of the lawyers, or a Court Reporter's facility, and transcripts are available to be used later for impeachment at trial or Motions to Dismiss or limit testimony. Many cases are won or lost during depositions.
